UK Supreme Court finds residents subjected to visual intrusion by Tate Modern viewing platform
Decision in Fearn and others v Board of Trustees of the Tate Gallery
The Supreme Court ruled on 1 February that the residents of a block of glass-walled flats next to the Tate Modern have been subjected to “constant visual intrusion” by visitors using the art gallery’s viewing platform. The decision overturns lower court rulings that had sided with Tate Modern in the privacy case between the gallery and residents of four apartments. The Supreme Court has remitted the case back to the High Court to determine whether residents are entitled to an injunction to prevent the viewing platform from being used.
