‘Fraud and the Justice System’ report response

Lloyd Firth, counsel in WilmerHale’s UK white collar defence and investigations practice, said anyone hoping for “concrete action” regarding the introduction of a ‘failure to prevent fraud’ offence “will be disappointed” with the government’s response to the Justice Select Committee report ‘Fraud and the Justice System’. He said while the government acknowledged the current law “does not adequately hold organisations and… senior persons to account”, no timeframe is given for its consideration of the Law Commission’s June 2022 paper. Firth concluded: “The long wait for consensus and action on the reform of corporate criminal liability… continues.”
