COSTS RULING

The appeal court has clarified who should pay costs when an interim injunction is granted. In Digby v Melford [2020] EWCA Civ 1647, the court affirmed the longstanding principle that when it issues an interim injunction, costs will normally be reserved unless there are special factors. It overturned a ruling that the claimant pay costs of £277,000 for two short unopposed hearings.
