Apple fined for breaching sanctions

Apple Distribution International, a subsidiary of the US technology giant, has faced repercussions after breaching sanctions relating to Russia
The UK's Office of Financial Sanctions Implementation (OFSI) has levied a fine against the company for its failure to comply with these regulations. Leading disputes lawyer Neil Dooley, a partner at Quillon Law, shared insights on the case, emphasising the need for stringent sanctions policies within corporations.
Dooley remarked that "Today's announcement illustrates the importance of companies having robust sanctions policies to ensure payments are not made inadvertently to sanctioned entities." He further noted that while there is "no suggestion that Apple sought to circumvent sanctions," there was a clear failure to update their payment systems, leading to payments made in mid-2022 to an entity previously owned by Sberbank, a significant Russian bank sanctioned in February 2022.
Dooley continued, stating that when Apple became aware of the potential breach, the company promptly notified OFSI. He explained that "it is then clear there were significant communications over 3 years to negotiate the fine, taking into account various mitigating factors including that Apple had self-reported the potential breach and had undertaken remedial measures to improve sanctions compliance." By reaching a settlement with OFSI, Apple managed to secure a 35% reduction in the imposed fine, which Dooley argues will serve as a template for managing sanctions breaches in the future.
