Fairstate Ltd v First Secretary of State and Westminster City Council (2005)

Where a flat had been used for 14 years as temporary sleeping accommodation but that period was interrupted by a tenancy for more than 90 days, the resumption of use for temporary sleeping accommodation was deemed to be a material change of use by the Greater London Council (General Powers) Act 1973, s 25 which caused a new 10-year period to begin to run for enforcement purposes under the Town and Country Planning Act 1990, s 171B(3).
