RE J (A CHILD: DISCLOSURE)

The court summarised the approach to be applied when deciding whether to order the disclosure of third party allegations of sexual abuse in child contact proceedings. A judge had erred in conflating the issue of whether the complainant should give oral evidence with the question of disclosure of the substance of her allegations.
